§ 1 Introduction

1. The ASTRIVA online store operates at https://astriva.pl. The entity responsible for its operation is Astriva sp. z o.o., KRS: 0001079550, NIP: 6222853025, REGON: 527378733. 2. This document regulates the rules of operation of the online store and determines the manner of concluding sales contracts with customers — both consumers and entrepreneurs — as part of remote sales.

§ 2 Glossary of terms

1. Consumer — a natural person who concludes a contract with the Seller not directly related to his business or professional activity.
2. Seller — Astriva sp. z o.o., with registered office and mailing address in Przybysławice 5A, 63-440 Raszków.
3. Customer — any entity purchasing products through an online store.
4. Entrepreneur — a natural person, legal entity or organizational unit with legal capacity, conducting business activities and using the store's offer.
5. Shop — online service available at https://astriva.pl
6. Distance contract — a contract of sale concluded via the Internet, without the simultaneous presence of the parties.
7. Terms and Conditions — this document.
8. Order — the customer's request for the purchase of a product or products, submitted through the order form available in the Store.
9. Account — an individual customer panel in the store, where data and order history are stored.
10. Registration form — a tool that allows you to create an account in the store.
11. Order form — an interactive form for placing orders, with options for selecting products and terms of the transaction.
12. Shopping cart — an element of the store system that allows you to select products and configure your order.
13. Product — physical goods available in the store, which can be purchased by the customer.
14. Sales contract — an agreement concluded between the Seller and the Customer, covering the sale of goods, services or works.

§ 4 Technical requirements

To use the store, the customer needs:

1. devices with Internet access and a web browser,
2. active email address,
3. active use of cookies.

§ 5 General information

1. The Seller is not responsible for interruptions in the operation of the store resulting from independent causes, e.g. force majeure or technical irregularities.
2. You do not need to log in to view the store's offer. Orders can be placed from the account or as a guest, after providing the data necessary for the execution of the order.
3. All prices in the store are given in PLN gross.
4. The total amount of payment includes the price of the goods and shipping costs, which are indicated before the purchase is finalized.
5. In cases where the final price cannot be determined in advance, the customer will be informed of how to calculate it.

§ 6 Account registration

1. An account can be created through the registration form.
2. Registration is free.
3. Login is carried out by entering a login and password.
4. The customer can delete the account at any time by sending a corresponding request by e-mail or mail.

§ 7 How to place an order

To make a purchase:

1. (optional) log in to the store,
2. select a product and add it to the cart,
3. log in or continue without registration,
4. fill out the order form (address, invoice details, delivery form),
5. click on “Order and pay”, then confirm the order (if required - by clicking on the link in the email),
6. select the payment method and pay for the order in accordance with § 8 paragraph 3.

§ 8 Delivery and payment

1. Forms of delivery: courier, parcel locker.
2. Payment methods: bank transfer, online payments, payment card.
3. Details on delivery and payment options are available on the store's website.

§ 9 Execution of the order

1. The contract of sale is concluded after acceptance of the order by the Seller.
2. Confirmation of acceptance of the order is sent by e-mail.
3. In case of payment in advance, it must be made within 3 calendar days.
4. Products with different delivery dates:
   
   • by default, they are sent together after completion,
   • customer can request partial shipment.
5. Deliveries are made in the EU and Ukraine.
6. The cost of delivery is indicated on the store's website and when placing an order.
7. The shipment of the order takes place within 7 working days from the receipt of payment.

§ 10 Withdrawal from contract

1. The consumer may withdraw from the contract within 14 days without giving any reason.
2. The deadline is calculated from the day of delivery of the goods.
3. For multiple shipments — from the date of receipt of the last item.
4. When subscribing — from the date of receipt of the first product.
5. The statement must be submitted in any form before the deadline.
6. In the case of an electronic form, the Seller confirms the receipt by e-mail.
7. Effects of withdrawal:
   • the contract shall be deemed not to have been concluded,
   • refund within 14 days (including the cost of delivery),
   • return by bank transfer or in accordance with the agreed method,
   • return possible after receipt of the product or proof of its dispatch,
   • the product must be returned within 14 days,
   • the cost of return is borne by the consumer,
   • the customer is responsible for the reduction in the value of the goods resulting from improper use.
8. When the return is unusual — details and costs are in the product description.

§ 11 Complaints and warranties

1. The products are new.
2. The seller is responsible for the defects of things.
3. Complaints can be submitted in writing to the company's address or by e-mail: sklep@astriva.pl.
4. The application must describe the defect, the circumstances and the request.
5. Returns as part of the complaint must be sent to the address in § 3.
6. Warranty information (if applicable) can be found in the product description.

§ 12 Extrajudicial means of dispute resolution

1. Information on alternative dispute resolution methods is available on the websites of the UOKiK and from consumer ombudsmen.
2. The consumer can:
   • apply to the permanent consumer court,
   • submit a request for mediation to the IH inspector,
   • use the free help of a consumer ombudsman or consumer organisations.

§ 13 Personal data

1. The data administrator is the Seller.
2. The data is processed for the purpose of fulfilling the order, and with the consent — also for marketing.
3. Data may be shared:
   
   1. companies delivering parcels,
   2. payment operators.
4. The customer has the right to inspect and correct the data.
5. The provision of data is voluntary, but necessary for the conclusion of the contract.

§ 14 Final provisions

1. The language of contracts concluded in the store is Polish.
2. The seller may change the terms and conditions for important reasons, e.g. changes in regulations. Notice of changes will be given at least 7 days in advance.
3. In unregulated matters, the provisions of Polish law apply.
